INSTRUCTIONS

  1. This Application is to be used to request a review by the Board of Equalization of the eligibility of property for Farmland Assessment as provided in Section 59-2-501, et. seq., of the Utah Code.

  2. This Application will be denied if the Board of Equalization finds that the property does not qualify for Farmland Assessment.

  3. This Application, when completed, should be filed with the Utah County Auditor, 100 East Center Street, Suite 3600, Provo, Utah, 84606. The completed Application must be filed within 30 days from the date of the audit letter which first notified you that the property did not qualify for Farmland Assessment.

  4. Provide all of the information requested on this form. Valuation can be obtained from the County Assessor. Legal descriptions can be obtained from the County Assessor or County Recorder.

  5. The Affidavit of Circumstances portion of this form should provide a detailed explanation of the reasons why you believe the Board of Equalization should determine that the property qualifies for Farmland Assessment. Specific facts should be provided to show the acreage involved and the specific agricultural production per acre for the property.

  6. Attach all supporting documentation, including all documents and photographs which will establish the agricultural production per acre of the property. Documents might include tax documents, sales receipts, farm production records, signed statements from neighbors, lease agreements, and other documents showing the amount of agricultural production of the property.

  7. Information and documents which are not provided by you with this Application will normally not be received at the hearing.
